NOT A RENTAL AGREEMENT: This agreement is a contract with the company, Folsom Limo for the hiring of limousine services. The customer and the customer’s guests are expected to conduct themselves in a manner so as to not cause injury or damage to themselves, to third parties or to the hired limousine. Only one person can make the reservation and therefore, with your signature above, you agree to accept full responsibility for you and your guests. You authorize Folsom Limo to charge the card listed above for all charges incurred by customer and his/her guests. In the event of any damage to the exterior or interior of the limousine caused by a customer or any guests of the customer, in addition to the hourly rate for the limousine and chauffeur, there will be a minimum charge of $300.00 for the repair and/or general cleaning of the limousine. Should the customer or any of customer’s guests vomit in the limousine, the minimum charge for cleaning the damage caused by vomit will be $500.00. All of our vehicles are non-smoking and if it is found that you or your guests has smoked in the vehicle, there will be an additional charge of not less than $200, plus all cleaning costs. Charges for missing or broken glassware are $10 per item, except for decanters which are $75. The decision as to the normal use and soiling of the vehicle interior and exterior rests solely with the company and its decision is final. The customer is fully responsible for the repair of any damage to the vehicle caused by the customer or customer’s guests. In addition, you will be charged with any downtime for the vehicle at the rate of
$500.00 per day. Gratuities are not included in the price quoted. Customers are encouraged to give chauffeur a gratuity for excellent service. Folsom Limo is not responsible for illegal acts of customer or guests, and disclaims responsibility for factors beyond its control such as weather, traffic delays, unforeseen mechanical failures, and Acts of God. Folsom Limo reserves the right to substitute the vehicle with one of similar passenger count. The company in its sole discretion may terminate the hiring of the limousine at any time due to unruly conduct or damage to the vehicle, in which case the customer will be responsible for all charges and there will be no refund of any deposit. Folsom Limo has a 30 day cancellation policy. Should customer reserve a date, time and vehicle for hire and cancel the service less than 30 days prior to the date of service, company reserves the right to retain any deposits paid for service. Customer shall have one opportunity to reschedule service within 90 days of cancellation. Folsom Limo reserves the right to refuse service as it deems appropriate. Folsom Limo assumes no responsibility for personal property left in the vehicle. Final payment is due at the end of the trip. If not paid within three days additional fees will apply. Signature or verbal acceptance of the customer hiring the vehicle constitutes full and complete agreement and understanding of this contractual agreement. If any part of this agreement is deemed by a court to be unenforceable, it shall be severed and the remaining terms and conditions of this agreement shall remain in full force and effect. In the event that legal action is initiated to enforce the terms of this agreement, the prevailing party shall be entitled to recover all costs including attorney’s fees in addition to other damages provided by law.
